Practice Areas Overview
The Adler Law Group has over three decades of experience assisting insurance companies and policyholders in legal matters involving a significant number of interrelated claims, including: insurance coverage and bad faith, defective construction, fraudulent (or suspicious) insurance claims, intellectual property, and appellate advocacy. Like an antique clock which has numerous parts which interrelate with one another to satisfy the function of telling time, the Adler Law Group is involved in a variety of legal areas which are interrelated and thus satisfy the objective of properly representing its clients. Although our office is located in Los Angeles, we assist clients throughout California and, as requested, throughout the United States.
Insurance Coverage and Bad Faith
We are experienced in reviewing a large variety of insurance policies to determine whether a specific type of policy covers a given claim. If insurance companies and policyholders disagree with each other about such a coverage issue, we are able to assist by issuing coverage opinions. Thus, we have insurance carriers and policyholders in litigation, arbitration, and settlement discussions. We may also file declaratory relief actions to obtain a judicial determination as to whether a given policy covers the claim.
Defective Construction
The Adler Law Group has been intimately involved in handling all aspects of disputes involving construction defects and, in that context, has represented carriers and policyholders on coverage issues. The lawyers in the firm also represent insureds in the underlying actions seeking damages for defective construction. Our attorneys, because of their familiarity with the policies, have also been retained to interpret and apply insurance policies to such claims. To avoid future disputes over such claims, the firm has also drafted insurance policies (and endorsements) for programs marketed to contractors. In that context, the Adler Law Group has provided litigation assistance for such claims as:
- Disputes between carriers in the insurance market over competing coverage issues;
- Claims addressing the impact of new policy formats offered by carriers;
- Bad faith claims involving a denial of a defense or the claim itself;
- Resolution of policy language in declaratory relief actions; and
- Appeals regarding disputes over claimed construction defects.
Fraud
The Adler Law Group represents insurance carriers where fraudulent (or suspicious) claims are presented. Our attorneys are trained to focus on "red flags" and resolve the issues presented, including the potential for someone creating false documentation which appear to be genuine. Our goal is to protect our clients' interests by carefully investigating the claim and then identifying whether the claim is bogus (leading to a denial of coverage) or genuine (leading to a payment). Careful investigation assists the insurance carrier and the policyholder and thus avoids coverage disputes as well as bad faith claims.
Intellectual Property
The Adler Law Group provides clients with legal representation in intellectual property matters, including those involving trademarks, unfair competition, and trade secrets. Our attorneys are experienced in litigating such disputes.
Appellate Advocacy
The results of an appeal can have repercussions for an entire industry, making it critical to retain a law firm with substantial experience in appellate advocacy. The Adler Law Group has decades of experience in appellate advocacy, prevailing in nearly 70% of the appeals in which it has been involved, a far higher percentage than that of the average appellate lawyer. As testament to our expertise in this area of law, we are often retained as lead counsel in cases tried by other lawyers and to provide "fresh look" at cases in other areas of the country.
Expert Witness Services
Managing partner Erwin Adler is qualified to serve as an expert witness on various insurance claims involving such issues as coverage, bad faith, and proper claims handling practices. He has provided expert opinions for both insurance companies and policyholders, which have been accepted in state and federal courts (and the Korean Court of Patent Appeals). Erwin's exceptional expertise has been recognized and honored by the Society of Claims Law Associates.
